    By participating in Kiwi floss's giveaways, you agree to the following terms and conditions. Please read them carefully.

    1. Eligibility

    1.1. The giveaway is open to residents of New Zealand aged 13 years or over,

    2.1. To enter the giveaway, participants must:

    • Like and follow the Kiwi Floss Facebook page.
    • Follow any additional instructions provided in the giveaway post, such as liking a specific post, sharing a photo with one of our products, etc.

    2.2. Entries that do not meet the requirements will be disqualified and may result in prizes being redrawn.

    3. Use of Submitted Content

    3.1. By sharing photos, comments, or other content as part of the giveaway, you grant Kiwi Floss the right to use, repost, and display this content on our website and social media pages within a reasonable context.

    4. Winner Selection and Notification

    4.1. Winners will be selected at random from all eligible entries received via online tools and video will be posted on our Facebook page and or website.

    4.2. The winners will be announced on the Kiwi Floss Facebook page within 3 days of the closing date.

    4.3. Winners must contact Kiwi Floss via phone, email, or Facebook message within 7 days of the winner being announced. Failure to do so will result in forfeiture of the prize, and Kiwi Floss reserves the right to select another winner.

    5. Prizes

    5.1. The prize(s) will be detailed in the giveaway post. Prizes are non-transferable and no cash or other alternatives will be offered.

    5.2. Kiwi Floss reserves the right to substitute the prize with another of equivalent value without giving notice.

    6. Publicity

    6.1. By entering the giveaway, you consent to the use of your name, likeness, and entry (including any photos submitted) in any publicity material, without further compensation, unless prohibited by law.

    7.1. Kiwi Floss reserves the right to cancel or amend the giveaway and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God, or any actual or anticipated breach of any applicable law or regulation or any other event outside of the company's control.

    8. Limitation of Liability

Insofar as is permitted by law, Kiwi Floss will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize except where it is caused by the negligence of Kiwi Floss.

    Refund and Returns Policy

    Kiwi Floss Refund Policy.

    Overview

    Due to dealing in Perishable items we can only offer a refund on Defective products such as overbaked bread or burnt Cotton candy or damaged packaging. if there is an issue with your product you can return it to us for a full refund where the claim is accepted.

    To complete your return, we require a receipt or proof of purchase.

    There are certain situations where only partial refunds are granted:

    • Where a product has been nearly fully consumed and may not satisfy us that the product was defective and we decide to honor a refund
    • Where the damage to the packaging would not effect the product's or consumers safety or wellbeing
    • where a receipt cannot be provided.

    If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, payments will be processed back to your payment method depending on the timeline your/our bank's standard processing time is.

    Late or missing refunds

    If you haven’t received a refund yet, first check your bank account again.

    Then contact your credit card company, it may take some time before your refund is officially posted.

    Next contact your bank. There is often some processing time before a refund is posted.

    Sale items

    Items on sale will only be refunded at Sale price a Receipt is required to receive a refund.

    We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at sales@kiwifloss.co.nz and send your item to: 32 Wescombe Grove Feilding 4702 New Zealand

    If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

    If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

    To return your product please speak with us and we will arrange a courier to collect it.

    You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

    Depending on where you live, the time it may take for your exchanged product to reach you may vary.

    If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

    Birthday Hire terms of service

    Kiwi Floss Birthday hire terms of service.

    Payment and Deposit

    1)You agree that the $25.00 Deposit is **non-refundable and to be paid to Golden Kiwi Bakery into account 06-0746-0812849-00 Using your Name as Reference and Date in the format of DD/MM/YY as Particulars when creating this booking.


    1.1)You agree that you will Pay the Balance owed on Arrival of our staff by method of cash or pay wave on the day of the event requested

    1.2 You agree that an outstanding balance will be invoiced to the e-mail address provided in this form if the balance is overdue by more than 30 days we may refer the debt to a debt collection agency at your expense.

    **(If the date is not available the Deposit and any further paid funds will be refunded)

    Fair use Policy.

    3)You agree that the number of guests is accurate and in the event of additional guests being present that it will fall under your fair use amount or you will communicate and pay for additional resources.

    4)You Acknowledge that a fair use applies of 5KG per 50 people this estimates out to around 2 Floss sticks per Guest

    4.1) You Agree that the Floss Hire is for 2 Hours we may voluntarily extend this time based on fair use (if limited amount of floss has been used) or being communicated on the day also dependent on our Calander bookings

    4.2) You agree that you will verbally communicate with staff on the day who is authorized to exceed Fair use and agree that in accepting further product you agree you may be invoiced for For product used at a rate of $50.00 Per KG (this will be confirmed on the day)

    Power Supply

    5) You Agree to supply 10 amp power up to 4000W for the trailer/Floss machine within 20 Meters of the arranged setup area this can be by power point supply or generator supplied. check with your venue holder for power availability if you need help with this let us know.

    Generator

    a generator can be made available for hire's where power is not possible but this will incur an additional $100.00 Fee this covers the hire of the generator + fuel for up too 2 hours. after this period its $9.00 per hour for fuel.

    Liability

    6) You Agree that in the unlikely event an individual or guest causes damage or harm to equipment/property owned by Golden Kiwi Bakery to be held liable for repair or replacement of said equipment or property within a timely manner.

    6) You Agree that Golden Kiwi Bakery and its staff will take all reasonable steps to prevent any damages or harm occurring during a party hire but we cannot guarantee unforeseen accidental damages or harm and you agree not to hold Golden Kiwi Bakery or its staff Liable for any accidental damages or harm that occurs

    Photography/Social Media

    7) You Agree that Kiwi Floss "Golden Kiwi Bakery" May take photos for the use of social media / advertising at the event All photos will be presented to the organizer for approval of use on social media before it is posted online at www.kiwifloss.co.nz or on its Facebook Page / TIKTOK Profiles.


    Consent to operate

    8)You Agree you have permission from (Venue organisers,Owners,Landlords,Council) or any other authority required to have our food trailer present at your event and we will require an estimated 2.5 x 3.0M Radius for the Trailer to be setup.

    9) Candy Floss Allocation
    Each party is allocated a specific number of candy floss servings as agreed upon at the time of booking. If the full quantity is not used during the event, no partial refunds will be issued. At the discretion of Kiwi Floss and subject to stock availability, pre-packed candy floss may be supplied as an alternative on the day.

    9.1) Unused Allocation
    If a party uses only a small portion of the allocated quota, we offer the option to pack the remaining candy floss to take home. This requires suitable packaging. Clients may supply their own sealable bags or request packaging from us, which is available at a cost of $1.00 per unit.
